Frivolous ADA Lawsuits

Some states have frivolous lawsuit laws. In NJ, for instance, if a judge determines the case filed against you falls into that category, you are reimbursed your legal fees in triplicate.

Odds are, the frivolous plaintiff is dead broke so doesn't have any money to pay that judgment ... and you spent $10g in legal fees to get the judgment.

I thought I'd give a little update. My lawyer got the case dismissed without prejudice (meaning it cannot be re-filed) He flooded the plaintiff with discovery under the penalty of perjury and the plaintiff folded like a cheap suit. I, of course, am out the lawyer fees. Even when you win, you lose.

My lawyer mentioned that 80% of these website ADA cases are in California (due to the Unruh Act) and that these "professional plaintiffs" pull in over $500,000 annually (from settlements). Its definitely crooked and it is definitely extortion.
you should counter sue.
